• Product information. We work to keep descriptions, prices, and availability accurate but don’t guarantee every detail; we may update, correct, or discontinue products at any time.
• Acceptable use. You agree not to break any law or third-party right, use the site unlawfully, interfere with or gain unauthorized access to our systems, act deceptively, or transmit harmful code.
• Intellectual property. All content — text, images, logos, trademarks, and design — belongs to Miss Fruttini or its licensors and may not be used without our written permission.

2. Orders & payment

• Availability. All orders are subject to availability. Because our products are handmade in small batches, an item may sell out after you order — we’ll offer an alternative or a refund.
• Pricing & payment. Prices show in the applicable currency and payment is due at checkout. We may refuse or cancel any order at our discretion (e.g. suspected fraud or a pricing error).
• Order confirmation. Your confirmation email means we received your order; acceptance happens when we ship it.
• Taxes. You are responsible for any applicable sales tax or fees, calculated at checkout where required.

3. Shipping & delivery

Our products are perishable and ship frozen using expedited, temperature-controlled service. Full details are in our Shipping Policy, which forms part of these Terms.

4. Returns & refunds

Because our sorbets are perishable, they generally can’t be returned once shipped, but we stand behind every order. See our Refund Policy for how we handle damaged, melted, incorrect, or undelivered orders. Except as required by law or expressly stated, products are provided without warranties of any kind.

5. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim is limited to the amount you paid for the product(s) giving rise to it. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or data. Nothing here limits liability that cannot be limited by law.

6. Indemnification

You agree to indemnify and hold harmless Miss Fruttini from any claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising from your breach of these Terms or misuse of our website.

7. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts in Miami-Dade County, Florida.

We may update these Terms from time to time. Changes take effect when posted here, and your continued use of the website means you accept them.
